Win, Lose or Draw (1925)

When Pierre Fayette and his daughter, Heloise, discover gold on their ranch, neighboring ranchers Fred Holt and Barney Sims accuse him of being an outlaw in an attempt to take over the property. Deputy Marshall Ben Austin starts an investigation before he is wounded in an ambush. Ben's brother, Ward, assumes his identity to finish the job. A short time later, Ward is thrown down a mine shaft by Holt and Sims, but his dog and horse come to the rescue. Ward quickly proves Pierre's innocence and wins the heart of Heloise.
